GM Could Be in Hot Water With FTC Over Truth in Advertising

General Motors is running ads on all the major networks this week claiming it has repaid its bailout from the taxpayers "in full." But the claim isn't standing up to scrutiny from lawmakers and government watchdogs who have found that the automaker was able to repay the bailout money only by dipping into a separate pot of bailout funds.

The TV spot may land GM in hot water with the Federal Trade Commission over its truth-in-advertising laws, which prohibit ads that are "likely to mislead consumers."
"We have repaid our government loans in full — with interest — five years ahead of the original schedule," says Ed Whitacre, chairman and CEO of General Motors Company, asking Americans to give the bankrupt company another look.
But a top Senate Republican has accused GM of misleading taxpayers about the loan repayment, saying the struggling auto giant was able to repay a $6.7 billion bailout loan only by using other bailout funds in a special escrow account.
Iowa Sen. Chuck Grassley's charge was backed up by the inspector general for the bailout — also known as the Trouble Asset Relief Program, or TARP. Watchdog Neil Barofsky told Fox News, as well as the Senate Finance Committee, that General Motors used bailout money to pay back the federal government.
"It appears to be nothing more than an elaborate TARP money shuffle," Grassley, the ranking Republican on the Senate Finance Committee, said in a letter Thursday to Treasury Secretary Timothy Geithner.
The FTC said it could not provide any comment on the ad or whether it had received any complaints or inquiries about GM's claims from the public or from government officials.
The FTC has a division of advertising practices that investigates possible false claims, but specific investigations are not made public. If the FTC determines that truth-in-advertising laws have been violated, the agency files complaints against the organizations in violation.
GM announced Wednesday that it had paid back the $8.1 billion in loans it received from the U.S. and Canadian governments in 2009. Of that, $6.7 billion went to the U.S. Treasury.
"A lot of Americans didn't agree with giving GM a second chance," Whitacre said in the 60-second ad. "We invite you to take a look at the new GM."
Well, meet the new GM. Same as the old GM. The company is still majority-owned by the federal government, which has a 60 percent stake in the Detroit titan; the Canadian government owns another 12 percent.
GM is not yet solvent, continues to be racked by debt and is still unable to turn a profit — something that has eluded the company since 2004. GM filed for bankruptcy in 2009 but was saved from collapse by a $52 billion infusion from the federal government.
But the company says the repaid TARP loan is a "good start," a signal that the company is emerging from its debts and moving back into the black.
"I think any way you look at it, that we're giving (loans) back with interest before we had to should be taken as a positive sign," said GM spokesman Greg Martin.
Martin said GM has not received any communications from the FTC or complaints from federal officials, and said that public feedback has been positive.
But Senator Grassley has called on Treasury Secretary Geithner to provide more information about why the company was allowed to use bailout money to repay bailout money, and how much of the remaining escrow money GM would be allowed to keep.
"The bottom line seems to be that the TARP loans were 'repaid' with other TARP funds in a Treasury escrow account. The TARP loans were not repaid from money GM is earning selling cars, as GM and the administration have claimed in their speeches, press releases and television commercials," he wrote.
But Barofsky told Fox News that while it's "somewhat good news," there's a big catch.
"I think the one thing that a lot of people overlook with this is where they got the money to pay back the loan. And it isn't from earnings. ... It's actually from another pool of TARP money that they've already received," he said Wednesday. "I don't think we should exaggerate it too much. Remember that the source of this money is just other TARP money."
Barofsky told the Senate Finance Committee the same thing Tuesday, and said the main way for the federal government to earn money out of GM would be through "a liquidation of its ownership interest."
Grassley criticized this scenario in his letter.
"The taxpayers are still on the hook, and whether TARP funds are ultimately recovered depends entirely on the government's ability to sell GM stock in the future. Treasury has merely exchanged a legal right to repayment for an uncertain hope of sharing in the future growth of GM. A debt-for-equity swap is not a repayment," Grassley wrote.

Obama funds $20M in tax payer dollars to immigrate Hamas Refugees to the USA . This is the news that didn't make the headlines...

By Executive Order, President Barack Obama has ordered the expenditure of $20.3 million in "migration assistance" to the Palestinian refugees and "conflict victims" in Gaza.
The "presidential determination," which allows hundreds of thousands of Palestinians with ties to Hamas to resettle in the United States, was signed and appears in the Federal Register.

Few on Capitol Hill, or in the media, took note that the order provides a free ticket replete with housing and food allowances to individuals who have displayed their overwhelming support to the Islamic Resistance Movement (Hamas) in the parliamentary election of January 2006.

Let's review....itemized list of some of Barack Obama's most recent actions since his inauguration:

His first call to any head of state, as president, was to Mahmoud Abbas, leader of Fatah party in the Palestinian territory.

His first one-on-one television interview with any news organization was with Al Arabia television.

He ordered Guantanamo Bay closed and all military trials of detainees halted.

He ordered overseas CIA interrogation centers closed.

He withdrew all charges against the masterminds behind the USS Cole and the "terror attack" on 9/11.
Now we learn that he is allowing hundreds of thousands of Palestinian refuges to move to, and live in, the US at American taxpayer expense.

These important, and insightful, issues are being "lost" in the blinding bail-outs and "stimulation" packages.

Doubtful ?

PHOENIX -- Gov. Jan Brewer ignored criticism from President Barack Obama on Friday and signed into law a bill supporters said would take handcuffs off police in dealing with illegal immigration in Arizona, the nation's busiest gateway for human and drug smuggling from Mexico.
With hundreds of protesters outside the state Capitol shouting that the bill would lead to civil rights abuses, Brewer said critics were "overreacting" and that she wouldn't tolerate racial profiling.
"We in Arizona have been more than patient waiting for Washington to act," Brewer said after signing the law. "But decades of inaction and misguided policy have created a dangerous and unacceptable situation."
Earlier Friday, Obama called the Arizona bill "misguided" and instructed the Justice Department to examine it to see if it's legal. He also said the federal government must enact immigration reform at the national level - or leave the door open to "irresponsibility by others."
"That includes, for example, the recent efforts in Arizona, which threaten to undermine basic notions of fairness that we cherish as Americans, as well as the trust between police and their communities that is so crucial to keeping us safe," Obama said.
The legislation, sent to the Republican governor by the GOP-led Legislature, makes it a crime under state law to be in the country illegally. It also requires local police officers to question people about their immigration status if there is reason to suspect they are illegal immigrants; allows lawsuits against government agencies that hinder enforcement of immigration laws; and makes it illegal to hire illegal immigrants for day labor or knowingly transport them.
The law sends "a clear message that Arizona is unfriendly to undocumented aliens," said Peter Spiro, a Temple University law professor and author of the book "Beyond Citizenship: American Identity After Globalization."
Brewer signed the bill in a state auditorium about a mile from the Capitol complex where some 2,000 demonstrators booed when county Supervisor Mary Rose Wilcox announced that "the governor did not listen to our prayers."
"It's going to change our lives," said Emilio Almodovar, a 13-year-old American citizen from Phoenix. "We can't walk to school any more. We can't be in the streets anymore without the pigs thinking we're illegal immigrants."
Protesters gathered in Miami Friday evening at the Freedom Tower, where thousands of Cuban refugees were processed after fleeing the communist revolution.
"A thousand people a day are being deported. A thousand families being destroyed. And this comes at a very high moral and financial cost to this nation," said Maria Rodriguez, executive director of the Florida Immigration Coalition.
The Mexican American Legal Defense and Education Fund said it plans a legal challenge to the law, arguing it "launches Arizona into a spiral of pervasive fear, community distrust, increased crime and costly litigation, with nationwide repercussions."
William Sanchez, president of the National Coalition of Latino Clergy and Christian Leaders Legal Defense Fund, said his group is preparing a federal lawsuit against Arizona to stop the law from being applied. The group represents 30,000 Evangelical churches nationwide, including 300 Latino pastors in Arizona.
"Millions of Latinos around the country are shocked," Sanchez said.
Mexico has warned the proposal could affect cross-border relations. On Thursday, Mexico's Senate unanimously passed a resolution urging Brewer to veto the law.
"Police in Arizona already treat migrants worse than animals," said Francisco Loureiro, an activist who runs a migrant shelter in the border town of Nogales, Mexico. "There is already a hunt for migrants, and now it will be open season under the cover of a law."
Guatemalan Vice President Rafael Estrada said the law "is a step back for those migrants who have fought" for their rights. Guatemala's Foreign Relations Department decried the measure in a statement saying "it threatens basic notions of justice."
The law will take effect in late July or early August, and Brewer ordered the state's law enforcement licensing agency to develop a training course on how to implement it without violating civil rights.
"We must enforce the law evenly, and without regard to skin color, accent, or social status," she said. "We must prove the alarmists and the cynics wrong."
Brewer, who faces a tough election battle and growing anger in the state over illegal immigrants, said the law "protects every Arizona citizen."
Anti-immigrant anger has swelled in the past month, after rancher Rob Krentz was found dead on his land north of Douglas, near the Mexico border. Authorities believe he was fatally shot by an illegal immigrant possibly connected to a drug smuggling cartel.
Arizona has an estimated 460,000 illegal immigrants, and its harsh, remote desert serves as the corridor for the majority of illegal immigrants and drugs moving north into the U.S. from Mexico.
U.S. Rep. Raul Grijalva, a Democrat, said he closed his Arizona offices at noon Friday after his staff in Yuma and Tucson were flooded with calls, some from people threatening violent acts and shouting racial slurs. He called on businesses and groups looking for convention and meeting locations to boycott Arizona.
The bill's Republican sponsor, state Rep. Russell Pearce of Mesa, said Obama and other critics of the bill were "against law enforcement, our citizens and the rule of law."
Pearce said the legislation would remove "political handcuffs" from police and help drive illegal immigrants from the state.
"Illegal is illegal," said Pearce, a driving force on the issue in Arizona. "We'll have less crime. We'll have lower taxes. We'll have safer neighborhoods. We'll have shorter lines in the emergency rooms. We'll have smaller classrooms."

A Dangerous Silence

I weep as I witness outrageous verbal attacks on Israel.  What makes these verbal assaults and distortions all the more painful is that they are being orchestrated by President Obama.
For me, the situation today recalls what occurred in 70 AD when the Roman emperor Vespasian launched a military campaign against the Jewish nation and its ancient capital of Jerusalem.  Ultimately, Masada, a rock plateau in the Judean desert became the last refuge of the Jewish people against the Roman onslaught.  I have been to Jerusalem and Masada.  From the top of Masada, you can still see the remains of the Roman fortifications and garrisons, and the stones and earth of the Roman siege ramp that was used to reach Masada. The Jews of Masada committed suicide rather than let themselves be taken captive by the Romans.
In Rome itself, I have seen the Arch of Titus with the sculpture showing enslaved Jews and the treasures of the Jewish Temple of Solomon with the Menorah, the symbol of the Jewish state, being carted away as booty during the sacking of Jerusalem.
Oh, you may say, that is a far fetched analogy.  Please hear me out.
The most recent sacking of the old city of Jerusalem – its Jewish quarter – took place under the Jordanians in 1948 in the first war between the Jews and the Arabs, with at least five Muslim states – Egypt, Jordan, Lebanon, Syria and Iraq – seeking to destroy the Jewish state.  At that time, Jordan conquered East Jerusalem and the West Bank and expelled every Jew living in the Jewish quarter of the old city, destroying every building, including the synagogues in the old quarter and expelling from every part of Judea and Samaria every Jew living there so that for the first time in thousands of years, the old walled city of Jerusalem and the adjacent West Bank were “Judenrein” — a term used by the Nazis to indicate the forced removal or murder of all Jews..
Jews had lived for centuries in Hebron, the city where Abraham, the first Jew, pitched his tent and where he now lies buried, it is believed, in a tomb with his wife, Sarah, as well as other ancient Jewish patriarchs and matriarchs.  I have visited that tomb and at the time  asked an Israeli soldier guarding it – so that it was open to all pilgrims, Christians, Muslims and Jews — “where is the seventh step leading to the tomb of Abraham and Sarah,” which was the furthest entry for Jews when the Muslims were the authority controlling the holy place?  He replied, “When we retook and reunited the whole city of Jerusalem and conquered the West Bank in 1967, we removed the steps, so now everyone can enter,” whereas when Muslims were in charge of the tomb, no Jew could enter it.  And I did.
I am not a religious person.  I am comfortable in a synagogue, but generally attend only twice a year, on the high holidays. When I entered the tomb of Abraham and Sarah, as I recall, I felt connected with my past and the traditions of my people. One is a Jew first by birth and then by religion. Those who leave their religion, remain Jews forever by virtue of their birth.  If they don't think so, let them ask their neighbors, who will remind them.  I recall the words of the columnist Robert Novak, who was for most of his life hostile to the Jewish state of Israel in an interview with a reporter stating that while he had converted to Catholicism, he was still a cultural Jew.  I remain with pride a Jew both by religion and culture.
My support for the Jewish state has been long and steadfast.  Never have I thought that I would leave the U.S. to go and live in Israel.  My loyalty and love is first to the U.S. which has given me, the son of Polish Jewish immigrants, so much.  But, I have also long been cognizant of the fact that every night when I went to sleep in peace and safety, there were Jewish communities around the world in danger.  And there was one country, Israel, that would give them sanctuary and would send its soldiers to fight for them and deliver them from evil, as Israel did at Entebbe in 1976.
I weep today because my president, Barack Obama, in a few weeks has changed the relationship between the U.S. and Israel from that of closest of allies to one in which there is an absence of trust on both sides.  The contrast between how the president and his administration deals with Israel and how it has decided to deal with the Karzai administration in Afghanistan is striking.
The Karzai administration, which operates a corrupt and opium-producing state, refuses to change its corrupt ways – the president's own brother is believed by many to run the drug traffic taking place in Afghanistan – and shows the utmost contempt for the U.S. is being hailed by the Obama administration as an ally and publicly treated with dignity.  Karzai recently even threatened to join the Taliban if we don't stop making demands on him.  Nevertheless, Karzai is receiving a gracious thank-you letter from President Obama.  The New York Times of April 10th reported, “.that Mr. Obama had sent Mr. Karzai a thank-you note expressing gratitude to the Afghan leader for dinner in Kabul.  'It was a respectful letter,' General Jones said.”
On the other hand, our closest ally – the one with the special relationship with the U.S., has been demeaned and slandered, held responsible by the administration for our problems in Afghanistan and Iraq and elsewhere in the Middle East.  The plan I suspect is to so weaken the resolve of the Jewish state and its leaders that it will be much easier to impose on Israel an American plan to resolve the Israeli-Palestinian conflict, leaving Israel's needs for security and defensible borders in the lurch.
I believe President Obama's policy is to create a whole new relationship with the Arab states of Saudi Arabia, Jordan and Egypt, and Iraq as a counter to Iran – The Tyrannosaurus Rex of the Muslim world which we are now prepared to see in possession of a nuclear weapon.  If throwing Israel under the bus is needed to accomplish this alliance, so be it.
I am shocked by the lack of outrage on the part of Israel's most ardent supporters.  The members of AIPAC, the chief pro-Israel lobbying organization in Washington, gave Secretary of State Hillary Clinton a standing ovation after she had carried out the instructions of President Obama and, in a 43-minute telephone call, angrily hectored Prime Minister Benjamin Netanyahu.
Members of Congress in both the House and Senate have made pitifully weak statements against Obama's mistreatment of Israel, if they made any at all. The Democratic members, in particular, are weak.  They are simply afraid to criticize President Obama.
What bothers me most of all is the shameful silence and lack of action by community leaders – Jew and Christian.  Where are they?  If this were a civil rights matter, the Jews would be in the mall in Washington protesting with and on behalf of our fellow American citizens.  I asked one prominent Jewish leader why no one is preparing a march on Washington similar to the one in 1963 at which I was present and Martin Luther King's memorable speech was given?  His reply was “Fifty people might come.”  Remember the 1930s? Few stood up.  They were silent.  Remember the most insightful statement of one of our greatest teachers, Rabbi Hillel: “If I am not for myself, who is for me?  And if I am only for myself, what am I?  And if not now, when?”
We have indeed stood up for everyone else.  When will we stand up for our brothers and sisters living in the Jewish state of Israel?
If Obama is seeking to build a siege ramp around Israel, the Jews of modern Israel will not commit suicide.  They are willing to negotiate a settlement with the Palestinians, but they will  not allow themselves to be bullied into following self-destructive policies.
To those who call me an alarmist, I reply that I'll be happy to apologize if I am proven wrong.  But those who stand silently by and watch the Obama administration abandon Israel, to whom will they apologize?

THE PATH TO A NATIONAL VAT TAX ... EVERYTHING IS AN EMERGENCY!!!


President Barack Obama quickly signed an extension of jobless benefits into law upon returning to the White House Thursday night.
The Senate approved an $18 billion extension to benefits on Thursday, sending the bill to the president. The legislation had been stalled in the Senate for weeks, causing a halt to benefits for hundreds of thousands of unemployed workers. 
The legislation approved Thursday night provides benefits retroactively to cover that gap. 
The package restores unemployment insurance and COBRA healthcare plan benefits that had lapsed since the end of March.
 Senators had struggled to pass the extension before leaving for a two-week recess, despite the benefits having expired at the end of that month. Sen. Tom Coburn (R-Okla.) had led Republicans in objecting to the extension until spending offsets could be found to fund it. Democrats had said the spending was for emergency purposes, and didn't need to be subjected to pay-as-you-go rules.

EMERGENCY PURPOSES ARE NOT SUBJECTED TO PAY-AS-YOU-GO RULES!!! WELL, ISN'T THAT JUST PEACHY!!!

THE GREAT LIE ... OF THE GREAT DEPRESSION ... READ IT A WEEP


The economy took off after the postwar Congress cut taxes.

'He got us out of the Great Depression." That's probably the most frequent comment made about President Franklin Roosevelt, who died 65 years ago today. Every Democratic president from Truman to Obama has believed it, and each has used FDR's New Deal as a model for expanding the government.

It's a myth. FDR did not get us out of the Great Depression—not during the 1930s, and only in a limited sense during World War II.

Let's start with the New Deal. Its various alphabet-soup agencies—the WPA, AAA, NRA and even the TVA (Tennessee Valley Authority)—failed to create sustainable jobs. In May 1939, U.S. unemployment still exceeded 20%. European countries, according to a League of Nations survey, averaged only about 12% in 1938. The New Deal, by forcing taxes up and discouraging entrepreneurs from investing, probably did more harm than good.

What about World War II? We need to understand that the near-full employment during the conflict was temporary. Ten million to 12 million soldiers overseas and another 10 million to 15 million people making tanks, bullets and war materiel do not a lasting recovery make. The country essentially traded temporary jobs for a skyrocketing national debt. Many of those jobs had little or no value after the war.

No one knew this more than FDR himself. His key advisers were frantic at the possibility of the Great Depression's return when the war ended and the soldiers came home. The president believed a New Deal revival was the answer—and on Oct. 28, 1944, about six months before his death, he spelled out his vision for a postwar America. It included government-subsidized housing, federal involvement in health care, more TVA projects, and the "right to a useful and remunerative job" provided by the federal government if necessary.

Roosevelt died before the war ended and before he could implement his New Deal revival. His successor, Harry Truman, in a 16,000 word message on Sept. 6, 1945, urged Congress to enact FDR's ideas as the best way to achieve full employment after the war.

Congress—both chambers with Democratic majorities—responded by just saying "no." No to the whole New Deal revival: no federal program for health care, no full-employment act, only limited federal housing, and no increase in minimum wage or Social Security benefits.
Instead, Congress reduced taxes. Income tax rates were cut across the board. FDR's top marginal rate, 94% on all income over $200,000, was cut to 86.45%. The lowest rate was cut to 19% from 23%, and with a change in the amount of income exempt from taxation an estimated 12 million Americans were eliminated from the tax rolls entirely.

Corporate tax rates were trimmed and FDR's "excess profits" tax was repealed, which meant that top marginal corporate tax rates effectively went to 38% from 90% after 1945.
Georgia Sen. Walter George, chairman of the Senate Finance Committee, defended the Revenue Act of 1945 with arguments that today we would call "supply-side economics." If the tax bill "has the effect which it is hoped it will have," George said, "it will so stimulate the expansion of business as to bring in a greater total revenue."

He was prophetic. By the late 1940s, a revived economy was generating more annual federal revenue than the U.S. had received during the war years, when tax rates were higher. Price controls from the war were also eliminated by the end of 1946. The U.S. began running budget surpluses.

Congress substituted the tonic of freedom for FDR's New Deal revival and the American economy recovered well. Unemployment, which had been in double digits throughout the 1930s, was only 3.9% in 1946 and, except for a couple of short recessions, remained in that range for the next decade.

The Great Depression was over, no thanks to FDR. Yet the myth of his New Deal lives on. With the current effort by President Obama to emulate some of FDR's programs to get us out of the recent deep recession, this myth should be laid to rest.

$200 million per arrest ... who was hi-jacked?

Duncan Blasts "Useless" Air Marshal Service


Washington, DC -- Mr. DUNCAN:  Madam Speaker, probably the most needless, useless agency in the entire Federal Government is the Air Marshal Service.
In the Homeland Security Appropriations bill we will take up next week, we will appropriate $860 million for this needless, useless agency. This money is a total waste: $860 million for people to sit on airplanes and simply fly back and forth, back and forth. What a cushy, easy job. 
And listen to this paragraph from a front-page story in the USA Today last November: “Since 9/11, more than three dozen Federal air marshals have been charged with crimes, and hundreds more have been accused of misconduct. Cases range from drunken driving and domestic violence to aiding a human-trafficking ring and trying to smuggle explosives from Afghanistan.''
Actually, there have been many more arrests of Federal air marshals than that story reported, quite a few for felony offenses. In fact, more air marshals have been arrested than the number of people arrested by air marshals.
We now have approximately 4,000 in the Federal Air Marshals Service, yet they have made an average of just 4.2 arrests a year since 2001. This comes out to an average of about one arrest a year per 1,000 employees.
Now, let me make that clear. Their thousands of employees are not making one arrest per year each. They are averaging slightly over four arrests each year by the entire agency. In other words, we are spending approximately $200 million per arrest. Let me repeat that: we are spending approximately $200 million per arrest.
Professor Ian Lustick of the University of Pennsylvania wrote last year about the money feeding frenzy of the war on terror. And he wrote this: “Nearly 7 years after September 11, 2001,'' he wrote this last year, “what accounts for the vast discrepancy between the terrorist threat facing America and the scale of our response? Why, absent any evidence of a serious terror threat, is a war to on terror so enormous, so all-encompassing, and still expanding?  The fundamental answer is that al Qaeda's most important accomplishment was not to hijack our planes but to hijack our political system.”
“For a multitude of politicians, interest groups and professional associations, corporations, media organizations, universities, local and State governments and Federal agency officials, the war on terror is now a major profit center, a funding bonanza, and a set of slogans and sound bites to be inserted into budget, grant, and contract proposals.''
And finally, Professor Lustick wrote: “For the country as a whole, however, it has become maelstrom of waste.'' And there is no agency for which those words are more applicable than the Federal Air Marshal Service.
In case anyone is wondering, the Air Marshal Service has done nothing to me, and I know none of its employees. But I do know with absolute certainty that this $860 million we are about to give them could be better spent on thousands of other things.
As far as I'm concerned, it is just money going down a drain for the little good it will do. When we are so many trillions of dollars in debt, a national debt of over $13 trillion, we simply cannot afford to waste money in this way.
